Herd Yard Terms of Service

Welcome to Herd Yard! By accessing or using our platform, you agree to these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use Herd Yard.

Overview
HerdYard provides an online marketplace where users can list and browse cattle for sale. Herd Yard does not buy, sell, or take ownership of cattle—we simply connect buyers and sellers. All transactions and negotiations take place directly between users.

User Responsibilities
- Sellers
  By listing cattle on Herd Yard, you agree to the following:
  - You have full legal ownership of the livestock being sold.
  - Your listings are accurate and truthful and comply with all applicable laws.
  - You are responsible for meeting all health, vaccination, and regulatory requirements for selling livestock in your state.
  - You will not engage in fraudulent, misleading, or deceptive practices.
- Buyers
  By purchasing livestock through Herd Yard, you acknowledge that:
  - All purchases are made directly from the seller, and Herd Yard does not guarantee the condition, health, or delivery of livestock.
  - You are responsible for verifying the health and quality of the cattle before completing any purchase.
  - You must comply with all applicable laws regarding the transport and ownership of livestock.

Fees and Payments
- Sellers must pay a $49 listing fee per cattle listing. All listing fees are non-refundable, regardless of whether a sale is completed.
- Herd Yard does not process payments for cattle sales; all transactions occur directly between buyers and sellers.

Prohibited Activities
- Sell cattle that are sick, diseased, or otherwise unfit for sale in accordance with USDA and state laws.
- Post false, misleading, or fraudulent listings.
- Engage in illegal activities, harassment, or abuse of other users.
- Use Herd Yard for any purpose other than buying or selling livestock.

Limitation of Liability
Herd Yard is not responsible for any disputes, losses, damages, or claims arising from transactions between users. We do not:
- Guarantee the accuracy of listings.
- Verify the health or condition of livestock.
- Mediate disputes between buyers and sellers.
Users agree to hold Herd Yard harmless from any claims related to livestock transactions, including but not limited to misrepresentation, non-delivery, or financial losses.

Dispute Resolution
HerdYard does not mediate disputes but encourages buyers and sellers to resolve issues independently. If disputes cannot be resolved, users should pursue legal action independently.

Changes to These Terms
Herd Yard reserves the right to update these Terms at any time. Changes will be posted on our website and will take effect immediately upon posting.
